These Terms & Conditions (“Terms”) govern access to the Miel Detail Co. website and, where applicable, requests for, authorization of, purchase of, and participation in services provided by Miel Detail Co.

“Miel Detail Co.,” “we,” “us,” and “our” refer to Miel Detail Co. “Customer,” “you,” and “your” refer to the individual requesting, purchasing, authorizing, or receiving services or using our website.

Please read these Terms carefully before requesting or purchasing services.

By booking or authorizing services and affirmatively accepting these Terms when presented, you acknowledge that you have had an opportunity to review the applicable Terms and policies.

Nothing in these Terms is intended to waive, restrict, or eliminate any consumer right, remedy, warranty, duty, or liability that cannot lawfully be waived or limited under applicable law.

1. About Miel Detail Co.

Miel Detail Co. is a veteran-owned mobile auto detailing business providing appointment-based vehicle detailing services in Los Angeles County and surrounding approved service areas in Southern California.

Services are subject to availability and may be affected by vehicle condition, service location, weather, safety considerations, equipment limitations, access restrictions, and other circumstances relevant to providing mobile detailing services.

2. Agreement to Applicable Terms

Depending on the service requested, a transaction with Miel Detail Co. may also be governed by additional documents or policies, including:

  • Privacy Policy
  • Booking & Cancellation Policy
  • Payment & Refund Policy
  • Detailing Service Agreement or Service Terms
  • Written estimate
  • Invoice
  • Service authorization
  • Add-on authorization
  • Service-specific disclosures

These documents are incorporated into the applicable transaction when presented or expressly referenced as applying to that transaction.

If a specific written service authorization conflicts with these general Terms concerning the particular work being performed, the more specific service authorization will generally control with respect to that work, subject to applicable law.

3. Eligibility and Authority to Authorize Services

Customers independently booking services must be at least 18 years old and legally capable of entering into the transaction.

By authorizing work on a vehicle, you represent that you either own the vehicle or have authority from its owner to authorize the requested services.

If you authorize services for a vehicle owned by another individual, employer, leasing company, rental company, fleet operator, or other entity, you are responsible for obtaining any authorization required from that owner.

4. Appointment Requests Are Not Automatically Accepted

Submitting a website form, requesting a consultation, sending a message, requesting a quote, or selecting an appointment time does not necessarily constitute acceptance of the appointment by Miel Detail Co.

An appointment is considered accepted when confirmed through our applicable booking or communication process.

Miel Detail Co. may decline a service request when reasonably necessary for legitimate safety, operational, payment, vehicle-condition, location, scheduling, or business reasons, subject to applicable law.

5. Estimates and Starting Prices

Unless expressly identified as a fixed price, website prices, telephone quotes, online estimates, and preliminary estimates may be based on information supplied by the customer and may constitute starting prices or estimates.

Pricing may depend upon factors including:

  • Vehicle size
  • Vehicle type
  • Vehicle condition
  • Service package
  • Required labor
  • Contamination
  • Interior condition
  • Exterior condition
  • Accessibility
  • Requested add-ons
  • Specialized treatment
  • Unusual or unexpected conditions

Photographs and customer descriptions can assist with estimating but may not reveal every condition.

A final inspection may reveal conditions requiring additional time, products, equipment, or services.

Miel Detail Co. will obtain customer authorization before performing additional work that results in a material additional charge beyond the previously authorized scope.

6. Undisclosed or Unexpected Vehicle Conditions

Customers should disclose unusual or significant conditions that may affect the requested service.

Examples include:

  • Heavy pet hair
  • Human or animal waste
  • Vomit, blood, urine, feces, or other biological material
  • Mold or suspected mold
  • Insect or pest infestation
  • Needles, sharps, or potentially hazardous objects
  • Chemical contamination
  • Excessive trash
  • Heavy mud or sand
  • Severe odors
  • Smoke contamination
  • Water intrusion
  • Flood damage
  • Fire damage
  • Loose interior components
  • Known electrical problems
  • Recently repaired or repainted surfaces
  • Failing paint
  • Damaged paint protection film
  • Failing vinyl wrap
  • Loose trim
  • Aftermarket modifications

Miel Detail Co. may stop or decline work when an undisclosed condition creates a health, safety, equipment, property, or service-quality concern.

Additional work will not be performed for an additional material charge without authorization.

7. Hazardous and Biohazardous Conditions

Standard automotive detailing is not a substitute for professional hazardous-material, biohazard, mold-remediation, pest-remediation, or environmental-cleanup services.

Miel Detail Co. may decline or discontinue service if we reasonably determine that a vehicle contains materials or conditions outside the scope of ordinary automotive detailing or that could create an unreasonable health or safety risk.

This may include bodily fluids, human or animal waste, needles, suspected controlled substances, significant mold, chemical contamination, pests, or unknown hazardous materials.

We may recommend that the customer obtain specialized remediation before detailing services are performed.

8. Service Location Requirements

Because services are mobile, the customer is responsible for providing or identifying a lawful, accessible, and reasonably safe location for the work.

The location should provide sufficient space to safely work around the vehicle and should not expose workers, customers, equipment, surrounding property, or vehicles to unreasonable hazards.

The customer is responsible for obtaining any required permission from:

  • Property owners
  • Landlords
  • Homeowners associations
  • Employers
  • Commercial properties
  • Parking facilities
  • Building management
  • Municipal authorities
  • Other persons controlling the property

Miel Detail Co. may decline, relocate, suspend, or reschedule service if the location is unsafe, prohibited, inaccessible, or otherwise unsuitable.

Miel Detail Co. is not responsible for a citation, towing event, access dispute, HOA issue, landlord dispute, parking violation, or similar consequence resulting from inaccurate information or the customer’s failure to obtain authorization for detailing at the requested location, except to the extent otherwise required by law.

9. Access to Water and Power

Miel Detail Co. may arrive with mobile water and power capabilities depending on the service and equipment configuration.

Certain services or circumstances may nevertheless require access to customer-provided utilities or other site accommodations.

Any such requirement will be communicated when reasonably practicable.

The customer must not knowingly direct Miel Detail Co. to use an unsafe, defective, overloaded, improperly grounded, or otherwise hazardous electrical outlet, water connection, or other utility source.

10. Weather and Environmental Conditions

Mobile detailing depends upon suitable environmental conditions.

Appointments may be modified, delayed, suspended, or rescheduled because of:

  • Rain
  • Lightning
  • Excessive heat
  • Excessive wind
  • Wildfire
  • Smoke or unsafe air quality
  • Flooding
  • Extreme weather
  • Water restrictions
  • Unsafe surface temperatures
  • Insufficient lighting
  • Unsafe working conditions
  • Other environmental conditions reasonably affecting safety or service quality

A decision by Miel Detail Co. to reschedule because conditions are unsuitable will not, by itself, constitute failure to provide the contracted service.

Applicable deposit and rescheduling treatment will be governed by the Booking & Cancellation Policy.

11. Vehicle Access and Limited Permission to Operate Vehicle

The customer must provide reasonable access to portions of the vehicle included in the authorized service.

When necessary, the customer may be required to provide the vehicle key, key card, remote, mobile access, or other means of access.

By providing access, the customer authorizes Miel Detail Co. to unlock, start, place into accessory mode, open compartments included within the authorized service, and reposition the vehicle only to the extent reasonably necessary to inspect, perform, or facilitate the authorized services.

This authorization does not permit recreational or unrelated operation of the vehicle.

12. Pre-Service Documentation

Miel Detail Co. may inspect and photograph or record the vehicle before work begins.

Documentation may include:

  • Paint condition
  • Wheels and tires
  • Windshield and glass
  • Body panels
  • Trim
  • Interior surfaces
  • Upholstery
  • Existing scratches
  • Dents
  • Chips
  • Cracks
  • Stains
  • Tears
  • Missing components
  • Warning indicators
  • Other visible conditions

Such documentation may be retained for service records, quality control, customer communication, insurance matters, or dispute resolution.

An inability to identify or photograph every pre-existing defect does not establish that an undocumented defect was caused during detailing.

13. Pre-Existing Damage and Deterioration

Miel Detail Co. is not responsible for damage, wear, deterioration, defects, or failures that existed before service.

Examples may include:

  • Clear-coat failure
  • Paint delamination
  • Oxidation
  • Rock chips
  • Scratches
  • Cracks
  • Dents
  • Rust or corrosion
  • Dry or brittle plastics
  • Cracked leather
  • Worn upholstery
  • Loose stitching
  • Loose trim
  • Failing adhesive
  • Damaged emblems
  • Cracked glass
  • Damaged wheels
  • Previously repaired surfaces
  • Improper repainting
  • Failing window tint
  • Mechanical defects
  • Electrical defects

Cleaning may remove dirt, oils, fillers, dressings, waxes, residue, or contamination that previously concealed a defect.

Accordingly, a pre-existing defect may become more visible after detailing without having been caused by the detailing process.

14. Fragile, Loose, Aged, or Deteriorated Components

Normal detailing processes involve water, air, vacuuming, towels, brushes, cleaning chemicals, pressure, agitation, and other appropriate detailing methods.

Aged, damaged, improperly installed, repaired, loose, brittle, deteriorated, or defective components may react differently to ordinary detailing procedures.

Customers should disclose known fragile or damaged components before work begins.

If Miel Detail Co. identifies a potentially fragile component, we may avoid the area, modify the service, recommend against treatment, or request additional authorization before proceeding.

15. Repainted and Previously Repaired Surfaces

Customers should disclose known repainting, body repairs, touch-up work, paint blending, refinishing, or other previous cosmetic repairs.

Aftermarket or repaired finishes may differ substantially from original factory finishes in thickness, adhesion, hardness, durability, and chemical resistance.

Miel Detail Co. may modify or decline a treatment when a repaired or repainted surface appears unsuitable for the requested procedure.

16. Paint Protection Film, Vinyl Wraps, Decals, and Graphics

Customers should disclose the presence and known condition of:

  • Paint protection film (PPF)
  • Vinyl wraps
  • Decals
  • Stripes
  • Graphics
  • Aftermarket badges
  • Protective films
  • Similar applied materials

Aged, improperly installed, damaged, lifting, cracked, peeling, or deteriorated materials may be vulnerable to ordinary cleaning and drying procedures.

Miel Detail Co. may decline to aggressively clean or treat areas where doing so could reasonably increase the risk of lifting or deterioration.

Miel Detail Co. is not responsible for failure attributable to pre-existing deterioration, defective installation, improper adhesion, aging, or another underlying defect, except to the extent liability cannot legally be excluded.

17. Ceramic Coatings, Sealants, Waxes, and Existing Protection

Customers should disclose known coatings or specialized protective treatments when relevant to the requested service.

Cleaning, decontamination, polishing, chemical treatment, or other detailing procedures may alter or remove previously applied waxes, sealants, coatings, dressings, or similar products.

When a service is specifically intended to remove, polish, decontaminate, or prepare a surface, alteration or removal of existing protection may be an expected part of the process.

18. Paint Enhancement, Polishing, and Paint Correction

Paint polishing and correction involve mechanical refinement of the painted surface and may remove a measurable but controlled amount of paint or clear coat.

The achievable result depends on:

  • Paint thickness
  • Defect depth
  • Paint hardness
  • Previous correction
  • Previous repairs
  • Clear-coat condition
  • Vehicle age
  • Manufacturer characteristics
  • Available material remaining

Not every scratch or defect can or should be removed.

Miel Detail Co. may intentionally leave deeper defects when further correction could compromise the integrity or longevity of the finish.

Safety and preservation of the paint system take priority over achieving complete defect removal.

19. No Guarantee of Complete Cosmetic Restoration

Automotive detailing improves and preserves vehicle appearance but is not equivalent to repainting, body repair, upholstery replacement, mechanical repair, restoration, or reconditioning.

Unless an express written guarantee is provided for a specific result, Miel Detail Co. does not guarantee complete removal of:

  • Scratches
  • Swirls
  • Water spots
  • Etching
  • Oxidation
  • Stains
  • Odors
  • Pet hair
  • Sand
  • Embedded contamination
  • Tree sap
  • Tar
  • Mineral deposits
  • Paint defects
  • Interior discoloration
  • Biological staining
  • Other permanent or deeply embedded defects

Statements about anticipated improvement are estimates based on professional judgment and are not guarantees of complete restoration.

20. Water Spots and Etching

Mineral deposits and water spots may range from surface contamination to permanent etching within glass, paint, coatings, trim, or other materials.

Removal may require chemical treatment, mechanical polishing, glass polishing, or other corrective procedures.

Some etching may be permanent or unsafe to fully remove.

Miel Detail Co. does not guarantee complete removal unless expressly agreed in writing.

21. Interior Stains and Odors

Stains and odors may originate beneath visible surfaces or within carpet padding, seat foam, ventilation systems, headliners, insulation, or other inaccessible areas.

Cleaning visible surfaces may not eliminate the underlying source.

Odor and stain treatment is therefore provided on an improvement basis unless a specific written result is expressly guaranteed.

Recurring odors or stains do not necessarily indicate that the service was performed improperly.

22. Pet Hair

Pet hair can become embedded within carpet, upholstery, seams, and fabrics.

The amount of labor required varies substantially between vehicles.

Pet-hair removal may require additional labor or an add-on charge disclosed for approval.

Complete removal of every hair cannot be guaranteed.

23. Headliners and Delicate Interior Materials

Headliners, aged fabrics, adhesives, specialty materials, soft-touch coatings, plastics, leather, vinyl, screens, piano-black surfaces, and other interior materials may be particularly delicate.

Miel Detail Co. may use reduced moisture, limited agitation, or alternative methods when appropriate.

Pre-existing adhesive deterioration, material failure, fading, delamination, cracking, or other deterioration may limit safe cleaning.

24. Electronics, Screens, Controls, and Electrical Components

Modern vehicles contain sensitive electronics and electrical components.

Miel Detail Co. uses reasonable care around screens, controls, switches, sensors, cameras, speakers, charging ports, modules, and electrical equipment.

Customers should disclose known defects or aftermarket electronic installations.

Miel Detail Co. is not responsible for a pre-existing electrical, software, battery, sensor, or component malfunction that becomes apparent during or after service unless caused by Miel Detail Co.’s legally actionable conduct.

25. Warning Lights and Mechanical Conditions

Detailing services do not include mechanical diagnosis.

If a vehicle displays a warning light, low battery condition, tire-pressure warning, diagnostic message, or other mechanical or electronic issue before, during, or after service, the customer remains responsible for obtaining appropriate diagnosis unless there is evidence that the condition resulted from the detailing service.

Miel Detail Co. does not represent itself as a mechanical repair facility.

26. Engine Bay Services

If engine-bay detailing is requested and offered, the customer should disclose known electrical issues, exposed wiring, aftermarket modifications, damaged connectors, missing covers, intake modifications, or other relevant conditions.

Engine-bay detailing will be performed using methods Miel Detail Co. considers appropriate under the circumstances.

We may decline engine-bay service when conditions create an unreasonable risk of damage.

27. Wheels, Tires, and Brake Components

Wheels may contain pre-existing:

  • Curb rash
  • Corrosion
  • Oxidation
  • Failing clear coat
  • Damaged finishes
  • Improper repairs
  • Embedded brake dust
  • Chemical staining
  • Structural damage

Cleaning may make existing defects more apparent.

Detailing is cosmetic and does not constitute inspection or certification of tire, wheel, or braking-system safety.

28. Glass

Scratches, chips, cracks, pitting, mineral etching, wiper damage, tint defects, and other glass conditions may be pre-existing.

Certain mineral deposits or scratches may not be removable through ordinary detailing.

Miel Detail Co. may decline aggressive glass correction when there is an unreasonable risk of damage.

29. Personal Property and Valuables

Customers should remove personal property before interior detailing, particularly:

  • Cash
  • Jewelry
  • Electronics
  • Identification documents
  • Financial documents
  • Medication
  • Keys unrelated to the vehicle
  • Fragile items
  • Sentimental items
  • Firearms or weapons
  • Other valuables

Miel Detail Co. may decline to move or handle items presenting a safety, privacy, legal, or damage concern.

We are not responsible for loss of undisclosed or unsecured property left in the vehicle except to the extent responsibility cannot legally be excluded.

30. Firearms, Weapons, and Dangerous Items

Customers must remove firearms, weapons, needles, controlled substances, and other dangerous or unlawful items before service.

If such an item is discovered, Miel Detail Co. may immediately stop work and secure or leave the area as reasonably appropriate.

Service may be cancelled or rescheduled according to the applicable policy.

31. Child Safety Seats

For safety and liability reasons, Miel Detail Co. generally will not install or certify the installation of child safety seats.

Customers wishing to have the area beneath a child seat cleaned should remove the seat before service when practical and are responsible for properly reinstalling it afterward.

If a seat is moved at the customer’s request, the customer remains responsible for verifying proper installation before use.

32. Customer Belongings and Interior Organization

Detailing does not include organizing personal belongings unless specifically agreed.

Excessive belongings may prevent access to portions of the vehicle.

Areas that cannot reasonably be accessed because of personal belongings may be omitted from the service.

33. Trunks, Cargo Areas, Glove Compartments, and Consoles

Closed storage compartments will be cleaned only when included in the service and when access is authorized.

Customers should remove confidential, valuable, dangerous, or sensitive materials before providing access.

Miel Detail Co. may decline to open or clean a compartment when its contents present a privacy, safety, or legal concern.

34. Photographs, Video, and Service Documentation

Miel Detail Co. may photograph or record a vehicle for legitimate operational purposes, including:

  • Pre-service condition documentation
  • Post-service documentation
  • Quality assurance
  • Customer communication
  • Insurance matters
  • Training documentation
  • Fraud prevention
  • Dispute resolution
  • Business records

Separate public marketing use of vehicle imagery may be governed by the applicable consent or media authorization.

When imagery is publicly used, reasonable efforts may be made to avoid intentionally displaying personally identifying customer information.

35. Customer Presence During Service

For safety and workflow reasons, customers and third parties should maintain reasonable distance from active equipment and the work area unless invited to approach.

Children and pets should be kept safely away from hoses, electrical equipment, chemicals, tools, moving vehicles, and active work areas.

Miel Detail Co. may temporarily pause work if people or animals create an unsafe working condition.

36. Completion Times

Any estimated service duration is an estimate rather than a guaranteed completion time.

Actual duration may change because of vehicle condition, weather, equipment, contamination, customer-requested additions, or other circumstances encountered during the service.

Customers should not schedule obligations that depend upon an exact completion time unless expressly confirmed.

37. Inspection After Service

Customers are encouraged to inspect the vehicle promptly after service when reasonably practicable.

If a customer believes there is a service-related problem, the customer should notify Miel Detail Co. as soon as reasonably possible and provide photographs or other information when appropriate.

Prompt notification helps preserve evidence and gives Miel Detail Co. an opportunity to evaluate the concern.

Failure to immediately discover a latent issue does not waive any non-waivable legal right.

38. Opportunity to Inspect and Address Service Concerns

When reasonably possible, customers should provide Miel Detail Co. an opportunity to inspect a claimed service-related issue before another business repairs, modifies, cleans, or alters the affected area.

This requirement is intended to preserve evidence and allow reasonable investigation.

Nothing in this provision prevents a customer from taking reasonable emergency measures to prevent additional damage or waives any right that cannot lawfully be waived.

39. Third-Party Repairs and Claims

Miel Detail Co. does not automatically accept responsibility for a third-party repair estimate merely because it is submitted following a detailing service.

Claims will be evaluated based on the facts, available documentation, pre-service condition, service performed, causation, applicable insurance procedures, and applicable law.

Customers should not authorize non-emergency third-party corrective work for which reimbursement is sought from Miel Detail Co. without first providing a reasonable opportunity for inspection when circumstances permit.

40. Customer-Caused Delay or Inability to Perform

Miel Detail Co. may be unable to complete some or all services when the customer:

  • Does not provide vehicle access
  • Is unavailable when access is required
  • Provides an unsuitable location
  • Fails to obtain property authorization
  • Leaves excessive belongings in the vehicle
  • Provides materially inaccurate vehicle information
  • Fails to disclose a hazardous condition
  • Interferes with safe performance
  • Requests work outside the agreed scope without sufficient time

Any resulting cancellation, rescheduling, or charge will be handled under the applicable booking and payment policies.

41. Right to Stop Work for Safety

Miel Detail Co. may stop work when continuing would reasonably create a significant risk to:

  • The customer
  • The vehicle
  • Miel Detail Co. personnel
  • Bystanders
  • Property
  • Equipment
  • The environment

When appropriate, we may recommend an alternative service or professional provider.

42. Refusal of Abusive or Unsafe Conduct

Miel Detail Co. may decline or discontinue service because of threatening, violent, harassing, discriminatory, abusive, fraudulent, or materially unsafe conduct, subject to applicable law.

Nothing in these Terms authorizes unlawful discrimination.

43. Payment Authorization

Customers are responsible for authorized services and approved additional charges.

Miel Detail Co. may use third-party payment processors.

The customer’s use of a payment method represents that the customer is authorized to use that payment method.

Customers should promptly contact Miel Detail Co. concerning a billing error so that it can be investigated.

44. Deposits

A deposit may be required to reserve an appointment.

Deposit amount, refundability, transferability, and application toward the final balance will be governed by the Booking & Cancellation Policy and the terms disclosed when the deposit is collected.

Nothing in these Terms eliminates a refund or cancellation right that applicable law requires.

45. Chargebacks and Payment Disputes

Customers retain all rights provided by their payment-card issuer and applicable law.

However, initiating a payment dispute does not automatically establish that a charge was unauthorized or that services were deficient.

Miel Detail Co. may provide the payment processor with relevant documentation regarding an authorized transaction, including:

  • Booking records
  • Acceptance records
  • Communications
  • Photographs
  • Invoices
  • Service documentation
  • Payment authorization
  • Applicable policies

Nothing in this section limits a customer’s lawful right to dispute a charge.

46. Promotions and Discounts

Promotions, coupons, referral offers, discounts, or promotional pricing may be subject to separate eligibility requirements and expiration dates.

Unless otherwise stated, promotions cannot necessarily be combined.

Miel Detail Co. may correct obvious promotional or pricing errors before a transaction is completed, subject to applicable law.

47. Gift Certificates and Credits

Any gift certificate, service credit, promotional credit, or similar item offered by Miel Detail Co. will be governed by the terms disclosed when issued and applicable California law.

Nothing in these Terms is intended to impose an expiration date, fee, forfeiture, or restriction prohibited by law.

48. Recurring or Membership Services

If Miel Detail Co. later offers a membership, maintenance plan, subscription, automatic renewal, or continuous service, additional terms and disclosures may apply.

Miel Detail Co. will obtain any consent and provide any cancellation mechanism, renewal notice, or other disclosure required by applicable law.

A customer’s participation in an individual detailing appointment does not by itself authorize future recurring charges.

49. No Unauthorized Recurring Charges

Miel Detail Co. will not interpret a customer’s prior purchase, saved payment method, or previous appointment as authorization to charge for a future service without appropriate authorization.

Recurring charges, if ever offered, will be governed by separate terms and applicable law.

50. Website Accuracy

Miel Detail Co. makes reasonable efforts to maintain accurate website information but does not warrant that every description, photograph, price, availability statement, duration, or other item will always be error-free or current.

We may correct errors and update information.

If an error materially affects an already accepted transaction, we will address the issue consistent with applicable law and the transaction circumstances.

51. Website Availability

Website access may occasionally be interrupted because of maintenance, hosting issues, cybersecurity events, internet outages, third-party failures, or other circumstances.

Miel Detail Co. does not guarantee uninterrupted website availability.

52. Third-Party Platforms

Our website or communications may integrate with independently operated services such as:

  • Booking platforms
  • Payment processors
  • Mapping services
  • Social media platforms
  • Analytics providers
  • Communication providers
  • Website hosting services

Use of those services may be governed by their own terms and privacy practices.

Miel Detail Co. is not responsible for the independent operation or conduct of third-party platforms except where applicable law provides otherwise.

53. Intellectual Property

The Miel Detail Co. name, original branding, logos, original photographs, written website content, graphics, service descriptions, and other proprietary content are owned by or licensed to Miel Detail Co. unless otherwise indicated.

You may not use Miel Detail Co. intellectual property in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization.

Nothing in these Terms restricts lawful fair use or another use permitted by law.

54. Customer Reviews and Feedback

Nothing in these Terms prohibits or restricts a customer from making an honest statement, review, assessment, or other lawful communication regarding Miel Detail Co. or its services.

Miel Detail Co. may respond to reviews or feedback and may dispute statements it reasonably believes are false, fraudulent, defamatory, or unrelated to a genuine customer experience through lawful means.

55. Privacy

Personal information is handled according to the Miel Detail Co. Privacy Policy and applicable law.

The Privacy Policy should be reviewed separately because it explains our information practices in greater detail.

56. Disclaimer Regarding Results

Except for an express written warranty or guarantee provided for a specific service, detailing results depend on factors outside Miel Detail Co.’s control, including vehicle age, materials, previous maintenance, previous repairs, environmental exposure, defect severity, and pre-existing condition.

Miel Detail Co. therefore does not warrant that every requested cosmetic result can be achieved.

This section does not disclaim warranties or rights that cannot lawfully be excluded.

57. Limitation of Liability

To the fullest extent permitted by applicable law, Miel Detail Co. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the website.

With respect to detailing services, Miel Detail Co. is responsible for liability to the extent imposed by applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence where it cannot legally be limited, violation of non-waivable statutory rights, or other liability that applicable law does not permit the parties to exclude.

58. No Assumption of Responsibility for Unrelated Conditions

The fact that a mechanical, electrical, cosmetic, software, battery, sensor, or other condition is discovered during or after detailing does not by itself establish that Miel Detail Co. caused the condition.

Responsibility for a claimed loss will depend upon evidence of causation, the vehicle’s pre-existing condition, the services performed, and applicable law.

59. Indemnification for Customer Misconduct

To the extent permitted by applicable law, a customer is responsible for claims, losses, or reasonable expenses resulting from the customer’s fraud, unlawful conduct, material misrepresentation, violation of another person’s property rights, or knowing provision of an unsafe service location.

This provision does not require a customer to indemnify Miel Detail Co. for Miel Detail Co.’s own liability where such indemnification would be prohibited by law.

60. Events Beyond Reasonable Control

Miel Detail Co. will not be responsible for a delay or inability to perform caused by circumstances reasonably beyond its control, including:

  • Severe weather
  • Wildfire
  • Natural disaster
  • Government restriction
  • Road closure
  • Civil emergency
  • Utility failure
  • Widespread communications outage
  • Supply disruption
  • Equipment failure despite reasonable maintenance
  • Other extraordinary events beyond reasonable control

When reasonably practicable, affected appointments will be rescheduled or otherwise addressed under the applicable policies.

61. Electronic Transactions and Acceptance

Where Miel Detail Co. offers electronic booking, authorization, estimates, invoices, or agreements, electronic records and electronic acceptance may be used as permitted by applicable law.

Checking an agreement box, selecting an acceptance button, signing electronically, or otherwise taking an affirmative action clearly identified as acceptance may constitute agreement to the applicable terms.

Miel Detail Co. may retain records reflecting the version of the terms presented and the customer’s acceptance.

62. Changes to Terms

Miel Detail Co. may update these Terms prospectively.

The “Last Updated” date will identify the current version.

Material changes will apply as permitted by law and will not retroactively eliminate rights that have already accrued.

The version presented or otherwise applicable when a transaction is entered into will generally govern that transaction unless the parties lawfully agree otherwise.

63. Governing Law

These Terms are governed by the laws of the State of California, except where another law must apply.

Nothing in these Terms deprives a consumer of a protection that cannot lawfully be waived.

64. Dispute Resolution

Customers are encouraged to contact Miel Detail Co. directly regarding a service or billing concern so that both parties have an opportunity to attempt to resolve the matter informally.

Nothing in this section prevents either party from exercising a right or remedy available under applicable law.

Unless a separate, legally enforceable dispute-resolution agreement applies, disputes may be pursued in a court or other forum having lawful jurisdiction.

65. No Waiver of Government or Consumer Rights

Nothing in these Terms prohibits a customer from contacting, communicating with, filing a complaint with, or cooperating with a government agency, regulator, law-enforcement agency, court, consumer-protection organization, or other entity where the customer has a lawful right to do so.

Nothing in these Terms waives rights under consumer-protection laws that cannot lawfully be waived.

66. Severability

If a provision of these Terms is found invalid or unenforceable, it will be limited or severed to the extent legally appropriate without invalidating the remaining provisions, unless applicable law requires otherwise.

67. No Waiver by Miel Detail Co.

Failure by Miel Detail Co. to enforce a provision on one occasion does not constitute a permanent waiver of that provision or another provision.

68. Headings

Section headings are provided for convenience and organization and do not independently expand or restrict the substantive meaning of these Terms.

69. Entire Agreement

For a particular transaction, these Terms together with the applicable estimate, invoice, Service Agreement, service authorization, Privacy Policy, Booking & Cancellation Policy, Payment & Refund Policy, and any other expressly incorporated terms constitute the applicable agreement concerning that transaction.

Oral discussions do not modify an expressly agreed written term unless the modification is subsequently agreed upon in a legally effective manner.
